ECOWAS Court Rejects Gertrude Torkornoo’s Bid for Reinstatement — But Says Ghana Must Face Human Rights Case

The ECOWAS Community Court of Justice has delivered a major ruling in the ongoing legal battle involving former Chief Justice Gertrude Torkornoo, refusing her request to be temporarily reinstated while her substantive case continues.

In its judgment on Wednesday, November 19, 2025, the regional court held that Justice Torkornoo failed to prove the level of “urgency” and “imminent, irreparable harm” required for the Court to issue an interim injunction against her removal.

According to the ruling, her application—filed nearly three months after her suspension—undermines her own argument. Deputy Attorney-General Dr. Justice Srem Sai, who represented the State, quoted the judgment:

“The Applicant’s own conduct defeats her claim of imminent and irreparable harm… The Court finds no basis to assess the remaining criteria for provisional measures.”

This means her request to pause all removal processes and return to office has been denied.
